Terms of Service

1. Agreement

By creating an account or using FloorVia, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service.

"FloorVia", "we", "us" refers to the operator (Carlos Filipe, Malta). "You" refers to the account holder.

2. Your account

• You must be at least 18 years old to create an account
• You provide accurate information (email, name where required)
• You are responsible for keeping your magic-link emails private
• You are responsible for all activity under your account
• One person per account; agency seats are individually named

We may suspend or terminate accounts that violate these Terms with or without notice.

3. Acceptable use

You may not:

• Use FloorVia for illegal property dealings, money laundering, or fraud
• Upload content that infringes third-party intellectual property or privacy
• Reverse-engineer, scrape, or attempt to extract our 3D engine, asset library, or source code
• Resell or sublicense FloorVia without a written agreement
• Spam or harass leads collected via our platform
• Interfere with the service (DDoS, abuse APIs, exceed rate limits)
• Use the platform to display content that is illegal, defamatory, or harmful

Violations may result in account suspension and forfeiture of unused subscription time.

4. Your content

You retain ownership of all content you create on FloorVia (project titles, descriptions, floor plans, photos, custom assets). You grant us a limited, non-exclusive license to host, process, and serve that content for the purpose of operating the service.

You confirm that:

• You have the right to upload and display the content (own work, licensed, or with permission)
• The content does not violate any third party's rights
• The content complies with applicable real estate advertising laws in your jurisdiction

We may remove content that violates these Terms or applicable law.

5. Billing + subscriptions

• Paid plans are billed monthly or annually via Stripe
• Prices are in EUR. EU VAT is added at checkout where applicable
• Subscriptions auto-renew until cancelled
• You authorize us to charge your card for renewals at the displayed rate
• Plan upgrades take effect immediately (pro-rated)
• Plan downgrades take effect at the next renewal
• Failed payments may result in suspension after a 7-day grace period

6. Free trial

The free trial includes:

• 14 days of access
• One 3D walkthrough creation
• Watermarked share page and PDF
• Lead capture (functional)
• No credit card required

At the end of the trial, projects archive automatically. Upgrade to a paid plan to keep them active. No automatic charge.

7. Cancellation + refunds

• You can cancel anytime from your dashboard
• Access continues until the end of the current billing period
• No refunds for partial months on monthly plans
• Annual plans: 14-day money-back window from initial purchase
• Pro-rated refund within 7 days of upgrade if you downgrade or cancel
• No refunds for plans cancelled due to Terms violation

8. Service availability

We aim for 99.5% uptime but do not guarantee uninterrupted service. Scheduled maintenance is announced in advance where possible.

SLA guarantees apply only to Agency and Enterprise plans, as documented in your specific subscription agreement.

9. Intellectual property

FloorVia, the brand, logo, and all underlying technology (3D engine, asset library, codebase, design system) are owned by Carlos Filipe / FloorVia. These Terms grant you a license to use the service, not to reproduce it.

The 3D walkthroughs you create are derivative works using our engine. You own the input content (specs, descriptions, uploaded images). You may export and use the rendered output (PDFs, share-page screenshots, embed iframes) for any lawful purpose.

10. Limitation of liability

To the maximum extent permitted by law:

• FloorVia is provided "as is" and "as available"
• We are not liable for indirect, incidental, or consequential damages
• Our total liability is limited to fees you paid in the 12 months preceding the claim
• We are not responsible for property transactions, viewing outcomes, or buyer behavior — we are a visualization tool, not an estate agent

11. Warranty disclaimer

3D walkthroughs are visual representations based on the data you provide. They may differ from the actual property in ways including but not limited to:

• Furniture style and placement (template-based)
• Materials and finishes (curated PBR library)
• Exact wall thickness, ceiling height, fixtures
• Outdoor surroundings, neighbors, traffic

You are responsible for ensuring buyers understand that the 3D is an illustration, not a guarantee. We recommend including a disclaimer on your share pages where required by your jurisdiction.

12. Governing law

These Terms are governed by the laws of Malta. Disputes are submitted to the exclusive jurisdiction of Maltese courts, except where you have mandatory consumer rights to bring suit in your country of residence.

13. Termination

You may close your account anytime. We may terminate or suspend your account if:

• You violate these Terms
• You fail to pay (after grace period)
• Required by law or court order
• The service is discontinued (60-day notice)

On termination, your data is exported on request and deleted within 30 days unless legally required to retain (e.g., billing records).

14. Changes

We may update these Terms when our service changes. Material changes are emailed to active account holders 30 days before taking effect. Continued use after the effective date constitutes acceptance.
